I agree with you (and another member of the IHE team who’d made much the same comment), so that will be going into the IHE response to DfT on Thursday. I think this reflects the history of the Regs, with crossings split over two separate Instruments at present and no one appreciating the need to consolidate, rather than just copy them.
You cannot amend primary legislation such as RTRA via a statutory instrument, but I think S25 of RTRA is sufficiently flexible already to apply to all types of crossing that include pedestrians (even if they also provide for cyclists or equestrians).
Please let me know if you spot anything else in the current draft that should be brought to DfT’s attention.
